The Bayala Dharug Application (“the App”) has been developed to support and inspire a growing Dharug language community by supporting Dharug community members and their allies to learn sentences and words in the Dharug language. The vision is for speakership of the Dharug language to grow and for our language to become stronger and stronger. Dharug is also known as the Sydney Language and has also been spelled Darug and Dharruk.
Bayala Aboriginal Corporation shares in the profound cultural responsibility of reviving Dharug Dhalang 'Dharug language', and is showing leadership in researching and publishing language resources, and providing learning opportunities in the home and through community, school and university courses. The App is part of a suite of activities and resources developed by Bayala Aboriginal Corporation to support Dharug language learning. The App has been co-designed by the Bayala Aboriginal Corporation with Western Sydney University and ElearnAustralia and funded by the Australian Institute for Aboriginal and Torres Strait Islander Studies (AIATSIS).
In developing the Bayala Dharug app, the Bayala Aboriginal Corporation acknowledges all the Dharug people, past and present, who have worked to care for and revive the Dharug language. The App builds on their language skills, resilience and work to support Dharug language learners now and into the future.
App content may not be used for commercial purposes as outlined in Conditions of Use below. In addition, the Bayala Dharug app may not be used as, or take the place of, a language program in educational settings including but not limited to early childhood settings, primary and secondary schools, universities and/or the TAFE/VET sectors. Anyone who downloads or uses the app must agree to the following:
You have to be at least 18 years old and can legally enter into a contract. If you are under 18 you have to ask a parent or guardian to agree to these Terms. They are then entering into the contract for you.
By downloading or using the App, you agree to be bound by these Terms (to follow these rules). If you disagree with any part of the Terms you must not use the App.
By using the App you are accepting the practices described in these Terms. These practices may change but we will inform you about any changes.
The App will collect information about which Dharug recordings are played, slowed down or marked as favourites; and which activities are used in the app. This allows Bayala Aboriginal Corporation to understand which Dharug language sentences and activities are most useful. This user data is anonymised: this data is not connected to or identifiable with any individual.
Your anonymous user data is stored on our secure servers. You can request to delete this at any time. To delete any collected user data email us at admin@bayala.net.au.
Information you give while using the App will be stored on our secure servers. Only authorised employees, licensees, and contractors who have formally agreed to keep information safe and private have access to this information. This information is encrypted or encoded to preserve anonymity.
Bayala Aboriginal Corporation can’t guarantee that your personal information could not by accident become available to other people. By using this App, you agree that you understand and accept the risk that any information you enter into the App may become available to other people and that you agree that Bayala Aboriginal Corporation and our partners are not liable (are not to blame) for any claim or demand related to that risk.
If you agree with and follow the terms and conditions described above, Bayala Aboriginal Corporation grants you a limited, non-exclusive, non-transferable license to view any Content only for your personal and non-commercial (not to make money) purposes. You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, download, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the App content except as expressly permitted in these Terms. Any misuse of the App may be pursued by Bayala Aboriginal Corporation to the fullest extent permitted by law.

All content such as, but not limited to, text, images, and sound files contained in the App are the property of Bayala Aboriginal Corporation. Copyright is owned by Bayala Aboriginal Corporation. No duplication or reproduction of content is permitted without express written permission from Bayala Aboriginal Corporation. Any rights not expressly granted herein are reserved.

You acknowledge and agree that if you give any feedback to us, you hereby grant to us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sub-licensable, and transferable license under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon, and otherwise exploit the feedback for any purpose without any compensation to you of any kind. (You can’t ask for payment for the feedback).
Bayala Aboriginal Corporation does not warrant (say) that the application software is error free, nor does Bayala Aboriginal Corporation make any warranty as to the results to be obtained from use of the App or content. The App and content are distributed on an “as is” basis. Bayala Aboriginal Corporation and their respective agents do not make any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties or merchantability or fitness for a particular purpose, with respect to the App or content.
Bayala Aboriginal Corporation does not warrant that any of the files available for downloading through the Apple Store or Google App Store will be free of viruses or similar contamination or destructive features. By downloading and/or using the App, you expressly agree that the entire risk as to the quality and performance of the products and the accuracy or completeness of the content is assumed solely by you the user. Bayala Aboriginal Corporation shall not be liable for any direct, indirect, incidental, special or consequential damages to you or your child(ren) arising out of the use of or inability to use the Application, even if such party has been advised of the possibility of such damages.
